These General Terms and Conditions apply to all accommodation, stays and other services of the Travel Agency Misa Tour, with its registered office at Limenaria, 640 02, Thassos, Greece ("Travel Agency Misa Tour").

These General Terms and Conditions form an integral part of the accommodation contract or other contract concluded between the customer and the travel agency Misa Tour and are valid and effective from 1.1.2020. The customer is a person who intends to conclude or concludes an accommodation contract with the Misa Tour travel agency, or a person in whose favor an accommodation contract has been concluded. The contracting parties agree that if the customer concludes an accommodation contract in favor of a third party and the third party rejects the acquired right under the accommodation contract, it will be fulfilled by the person who concluded the accommodation contract, unless otherwise agreed by Misa Tour travel agency and customer.

If the accommodation contract is concluded in a form other than written, Travel Agency Misa Tour will issue the customer a written document on the conclusion of the accommodation contract (confirmation of accommodation) immediately after the conclusion of such an accommodation contract.

Travel Agency Misa Tour deals with the rental of accommodation and mediation of tourism services. These GTC govern the rights and obligations of the parties to the accommodation contract.

1. Origin and subject of the contractual relationship


The contractual relationship between the Misa Tour travel agency and the customer arises on the basis of an accommodation contract concluded between the Misa Tour travel agency and the customer, and if the accommodation contract is not concluded in writing, the accommodation contract is concluded at the time of sending the accommodation confirmation. or an authorized representative to the customer's e-mail box or to his correspondence address.

By signing the accommodation contract, or by placing an accommodation order (if the accommodation contract is not concluded in writing), the customer confirms that he has read these General Terms and Conditions before concluding the accommodation contract.

These General Terms and Conditions regulate the rights and obligations of the contracting parties when booking accommodation, catering and other tourism services as individual services according to individual customer requirements.

In the event that the accommodation contract or other contractual agreement between Travel Agency Misa Tour and the customer states that the accommodation is "on request" or "on confirmation", then the contractual relationship between the customer and Travel Agency Misa Tour arises and the accommodation contract becomes effective by concluding an accommodation contract and at the same time paying the price of the accommodation by the customer, according to point 3. In such a case, the accommodation contract is negotiated with an untying condition. The untying condition is fulfilled in the event that the agreed accommodation is not available due to accommodation capacities or other objective reasons on the part of the Misa Tour travel agency. In the event that the termination conditions of the Travel Agency Misa Tour are fulfilled within 7 days of payment of the full price of accommodation, the customer will be notified or sent a notice of termination of the accommodation contract and will immediately return the paid funds in full. The customer agrees and acknowledges that in such a case he is not entitled to any compensation, discount, indemnification or other performance by Travel Agency Misa Tour in addition to the returned funds.

2. Prices of accommodation


Accommodation prices are final, include accommodation in the basic room type as described on the misatour.cz website and meals according to the contract for accommodation and delegate services.

The price of accommodation does not include travel insurance, visa, health test, optional services in the destination (eg optional trips, car rental, etc.).

The price includes all taxes and fees that Travel Agency Misa Tour is known at the time of preparation of the accommodation offer. If the additional costs cannot be reasonably quantified before concluding the accommodation contract, the Misa Tour Travel Agency will state the type of additional costs that the customer may still incur. Individual destinations have the right to introduce the obligation to pay other payments, such as tourist taxes. Therefore, these payments cannot be calculated in the total price of accommodation and their eventual payment will be made at the place of stay according to the instructions of local governments.

3. Payment terms


Travel Agency Misa Tour has the right to pay for the ordered services before they are provided. Any payment according to the accommodation contract is considered paid at the moment of crediting the relevant amount to the account of Travel Agency Misa Tour kept at the financial institution or by payment in cash at the office of Travel Agency Misa Tour, or at an authorized Misa Tour sales representative. In the event of non-compliance with the set payment date by the customer, Travel Agency Misa Tour has the right to withdraw from the contract and the customer is obliged to pay cancellation fees in accordance with Article 5, which does not affect Misa Tour's right to compensation.

Travel Agency Misa Tour is entitled to request a deposit of 50% of the total price of accommodation.

Travel Agency Misa Tour allows you to pay deposits as follows::

- 30% of the total price of accommodation when concluding an accommodation contract if this contract is concluded 120 or more days before the contractual start of the accommodation. A supplement to the required deposit of 50% of the final price of the accommodation is payable 90 days before the contractual start of the accommodation,

- 50% of the total price of accommodation at the conclusion of the accommodation contract if the contract is concluded 90 or less days before the contractual start of the accommodation,

Surcharge to the full amount of accommodation is payable after the customer's arrival at the accommodation.

The deposit is payable upon conclusion of the accommodation contract as stated above. If the deposit for the accommodation is not paid properly and on time, the customer is not entitled to accommodation and services.

In the case of ordering accommodation according to an individual order or on request, Misa Tour is entitled to require a deposit of 50% of the total price.

The customer is entitled to the provision of services upon timely payment of accommodation prices in the agreed amount.

4. Rights and obligations of the customer


The basic rights of the customer include:
a) the right to the proper provision of the agreed and paid services. If the customer does not use up the agreed services without the fault of Travel Agency Misa Tour, he is not entitled to a refund,
b) the right to request additional information if it was not listed on the misatour.cz website or was not communicated to the customer otherwise,
c) the right to be acquainted with changes in accommodation, range of services and prices,
d) the right to withdraw from the contract before the start of the contract under the conditions laid down in Article 5,
e) the right to notify the Travel Agency Misa Tour in writing that another person will take part in the accommodation in the event that the notification also includes a statement from a new customer that he agrees to the accommodation contract and meets all conditions for participation in the accommodation, hereinafter "rebooking". The original and new customers are jointly and severally liable for paying the price of accommodation, all before the start of accommodation,
f) the right to make a complaint in accordance with Article 8,
g) the right to the protection of personal data, which is stated in the accommodation contract and in other documents,

4.2. The basic duties of the customer include:
a) provide Travel Agency Misa Tour with the cooperation necessary for the proper security and provision of services, in particular fully and truthfully state the details in the accommodation contract, including any changes to such details, provide a contact phone (or email) on which the customer will be available if necessary , and submit the documents required by the Travel Agency Misa Tour to provide accommodation,
b) ensure that persons under the age of 15 are accompanied and supervised by an adult participant during the accommodation; similarly, to provide escort, supervision and necessary medical care to persons whose state of health requires it. If a customer who is older than 15 years and younger than 18 years of age intends to enter into an accommodation contract and draw services on the basis of it without the accompaniment and supervision of a legal representative, he is obliged to submit the legal representative's consent to such conclusion of the contract and use of services,
c) pay the price of accommodation in accordance with Articles 2 and 3.,
d) arrive at the place of accommodation at the appointed time,
e) have all the documents required for entry into the respective countries of residence and transit (valid travel document, visa, health insurance document, etc., if required), nationals of a state other than the Czech Republic are obliged to find out about the visa requirement at the embassies of the countries, where they travel and obtain the necessary visas,
f) compliance with passport, customs, health (including vaccination) and other regulations of the country to which he travels, compliance with the applicable legislation of the country of residence and respect for the different composition of the population and other cultural customs. The customer is fully responsible for his actions and behavior during the accommodation, possibly doing business abroad without the knowledge of Misa Tour. Misa Tour is not liable for any consequences caused by the customer's own irresponsibility. All costs and consequences arising from non-compliance with this provision shall be borne by the customer,
g) pay the agreed price of accommodation according to the concluded accommodation contract,
h) complain about all defects from the agreed services immediately after their discovery, preferably on the spot to a representative of the Travel Agency Misa Tour and provide the cooperation necessary to eliminate them,
i) refrain from actions that could endanger, damage or restrict other participants in the accommodation, the Travel Agency Misa Tour service provider or endanger or damage the name of the Travel Agency Misa Tour and / or its representative (possibly a delegate),
j) to pay for damage caused, for example, in accommodation and other facilities where he drew services provided under the accommodation contract,
k) follow the rules of good behavior, hygiene, do not disturb, limit, etc. other customers or persons,
l) take care of the proper and timely enforcement of any claims against service providers,

4. Changes to agreed services

If, after the start of the accommodation or during the use of the tourism services which are the subject of the contractual relationship with the customer, Travel Agency Misa Tour does not provide the services or a substantial part of them properly and in time, or finds that it will not be able to provide all the services properly and in time. Travel Agency Misa Tour is obliged to take such measures within a reasonable time and free of charge so that the accommodation can continue or so that the customer can draw services, in particular it is obliged to provide a replacement program and services to the extent and quality identical or close to the originally agreed conditions. while ensuring that the purpose of the services is achieved as far as possible and that adequate accommodation is maintained.

5. Withdrawal from the contract, cancellation fees


The customer can always withdraw from the accommodation contract before starting the accommodation, but Travel Agency Misa Tour only if the customer has breached his obligation (point 4.2). The effects of withdrawal from the accommodation contract occur upon delivery of the notice of withdrawal to the other party. The customer is obliged to pay Travel Agency Misa Tour, in connection with the withdrawal of cancellation fees according to point 5.3. Upon withdrawal from the accommodation contract, Travel Agency Misa Tour is obliged to return to the customer immediately, no later than 14 days after the termination of obligations under the contract, all payments made by the customer, reduced by any cancellation fees.

5.2. Upon withdrawal, the customer is not obliged to pay Travel Agency Misa Tour cancellation fees according to point 5.3 in these cases:
a) external circumstances force Travel Agency Misa Tour to substantially change any of the contracted services
b) Travel Agency Misa Tour cannot meet the special customer requirements it has accepted
d) Travel Agency Misa Tour withdrew from the accommodation contract due to cancellation of accommodation from the property owner.

5.3. If the reason for the customer's withdrawal from the contract is not a breach of Misa Tour obligations stipulated in the contract or if Misa Tour withdraws from the contract before starting services due to customer breach, the customer is obliged to pay Travel Agency Misa Tour cancellation fees in the amount of actual costs associated with cancellation. at least however:

- from the 121st day before the contractual date of entry 20% of the final price agreed in the accommodation contract
- from the 120th day to the 91st day before the contractual date of entry 30% of the final price agreed in the accommodation contract
- from the 90th day to the 0th day before the contractual date of entry 50% of the final price agreed in the accommodation contract
- 50% of the final price agreed in the accommodation contract if the customer does not come to the accommodation or does not exhaust the services without prior withdrawal from the contract

5.4. In addition to the breach of specific obligations arising from the concluded accommodation contract, cases where the customer seriously disrupts the course of accommodation, endangers the life and health of himself, or other customers or employees of the travel agency (or if there is a risk that this situation could occur), as well as cases where the customer is demonstrably under the influence of narcotics and addictive substances. The customer acknowledges that in case of withdrawal of Travel Agency Misa Tour from the accommodation contract during accommodation due to breach of obligations by the customer, he is not entitled to a refund of an aliquot of the price of services that were not used, and is obliged to pay Misa Tour all additional costs. created by Travel Agency Misa Tour.

5.5. The final price means the total price of accommodation, ie the sum of the basic price, mandatory surcharges and optional services purchased by the customer

5.6. The costs actually incurred are the operating costs of the Misa Tour and the contractually agreed or legally stipulated compensation for domestic and foreign service suppliers.

5.7. When determining the number of days for the calculation of severance pay, the day when the effects of withdrawal from the contract occurred is included in the determined number of days. The number of days does not include the day of departure or arrival at the relevant accommodation, etc.

5.8. Accommodation with own transport is subject to cancellation from the final price agreed in the accommodation contract according to point 5.3.

6. Help in difficulties, accommodation defects, advertising and liability for damages

6.1. Travel Agency Misa Tour is responsible for the proper provision of accommodation and is obliged to provide the customer with help in trouble. The customer has the opportunity to contact Misa Tour and communicate effectively with her (ask for help if she finds herself in trouble or criticizes a tour defect) at the Travel Agency headquarters, ie at the Travel Agency Misa Tour, Limenaria 640 02, Thassos, Greece or e e-mail address specified in the accommodation contract by telephone number specified on the misatour.cz website, which is in operation 24 hours a day and whose number is specified in the accommodation contract. If the customer is to blame for the problem, the organizer may, for his help, demand reasonable compensation for the costs actually incurred.

6.2. Ubytování má vadu, není-li poskytnuto v souladu se smlouvou o zájezdu.

6.3. If the accommodation is defective, the customer is obliged to notify the Travel Agency Misa Tour without undue delay. At the same time, the customer shall specify a reasonable period for rectification of the defect, unless Misa Tour refuses to rectify the defect or immediate remedial action is required. If the accommodation is defective and if the customer has criticized it without undue delay, the customer is entitled to a discount on the price in the amount appropriate to the extent and duration of the defect.

6.4. Travel Agency Misa Tour will eliminate the defect of the tour, unless this is not possible, or the elimination of the defect requires disproportionate costs with regard to the extent of the defect and the value of the travel services concerned. If Travel Agency Misa Tour does not eliminate the defect within the specified period, the customer has the right to eliminate the defect himself and demand reimbursement of the necessary costs.

6.5. In all circumstances, the customer is obliged to act in such a way as to prevent damage to himself, other customers, Travel Agency Misa Tour and business partners.

6.6. Travel Agency Misa Tour does not bear any responsibility and is not liable for the level, price or damage incurred for services and events not agreed in the trip contract, organized by other entities, which the customer orders on the spot at the hotel or other organization. Travel Agency Misa Tour is also not liable for damages and property damage caused to the customer, which are subject to contractual insurance coverage of the insurance company under the travel and residence insurance policy, or such damages and property damage that are explicitly excluded from the scope of insurance coverage, if the liability of the travel agency Travel Agency Misa Tour in these cases is not given by law. If there are circumstances whose origin, course and consequence does not depend on the activities and procedure of the Travel Agency Misa Tour (vis major) or circumstances on the part of the customer, based on which the customer does not fully or partially use the ordered, paid and travel agency Travel Agency Misa Tour secured tourism services, the customer is not entitled to payment or discount from the price of these services.

7. Travel insurance of the customer

The price of tours does not include insurance for medical expenses abroad or insurance in the event of withdrawal from the tour contract. Customers are advised to take out travel insurance, which includes, among other things, insurance against risks related to the cancellation of tours for reasons specified by the insurance company and additional insurance for Covid-19 or other pandemics. The customer acknowledges that if he does not use the recommendation of Travel Agency Misa Tour to take out insurance, Travel Agency Misa Tour is not obliged (beyond the legal framework) to provide anything to the uninsured customer in the event of an insured event and the customer bears all related risks.

8. Tourist tax

From 1 January 2018, tourist taxes were introduced in Greece, which are paid in cash directly at the accommodation and are subject to accommodation providers, not travel agents.

9. Measures due to Covid-19 or other pandemics

Please note that measures related to restrictions due to the epidemic are constantly changing and are becoming a new widely accepted socio-social and hygienic standard (eg wearing a veil, maintaining a minimum distance, limiting the number of service users). Restrictions may also apply to services in your hotel / apartment / studio: eg change of diet, restrictions in wellness, swimming pools or outdoor playgrounds. Hygiene measures in the hotel, restaurant or in the destination in general may change together with the improvement or worsening of the epidemiological situation in the country, as well as the conditions of entry into the destination may change (eg registration for entry, health test).

10. GDPR

The customer acknowledges that Travel Agency Misa Tour processes personal data provided by the customer or will provide Travel Agency Misa Tour in connection with the negotiation of an accommodation contract or other contract between the customer and Travel Agency Misa Tour, its conclusion and performance, as well as personal data that Travel Agency Misa Tour collects in connection with the provision of the agreed services to the customer.

In particular, the customer's identification and contact details and other information specified in the tour contract or collected in connection with its performance will be processed.

11. Final provisions

These General Terms and Conditions apply to all services provided by Travel Agency Misa Tour. Other provisions in the accommodation contract or in the special conditions take precedence over the wording of the General Terms and Conditions. Customers confirm by signing the accommodation contract, or by placing an accommodation order (if the accommodation contract is not concluded in writing), that they are aware of, understand, agree with and agree with the General Terms and Conditions, which are an integral part of the accommodation contract. they accept them in full.

All data and instructions contained on the misatour.cz website on services, prices and travel conditions correspond to the information known at the time of the last update and the travel agency reserves the right to change them, preferably if possible by concluding a trip contract with the customer. If the above facts change, Travel Agency Misa Tour will take such appropriate measures so that the customer is acquainted with the changes at the time of the offer of services. In the case of accommodation contracts already concluded, the travel agency shall inform the customer in an appropriate manner of these changes within the time limits laid down by law or these General Terms and Conditions, with the consequences thereof. The travel agency reserves the right to technical errors on the misatour.cz website.
